General Terms and Conditions for the hotel accommodation contract
This translation is provided for your convenience. Only the German version is legally binding.
- The hotel accommodation contract (rental agreement) between the customer (guest/booker/organiser) and the hotel is legally concluded as soon as the room/apartment/holiday apartment or the function room has been confirmed by the hotel in writing or – if written confirmation was no longer possible for reasons of time – has been confirmed verbally upon the customer’s arrival at the hotel. Conclusion of the hotel accommodation contract obliges the contracting parties to perform the contract.
- Accommodation rates and the prices of other services are based on the price list valid at the time the service is rendered or on individual written agreements. All prices are quoted in euros. The agreed prices include statutory VAT at the applicable rate. The agreed prices include the taxes and levies applicable at the time the contract is concluded. They do not include local levies which the customer (guest) is required to pay under municipal regulations, such as visitor’s tax or comparable charges. In the event of a change to statutory taxes, or the introduction, amendment or abolition of local levies, the hotel is entitled and obliged to adjust the agreed prices accordingly. In the case of contracts with consumers, this applies only if more than four months lie between conclusion and performance of the contract. The customer is entitled to withdraw from the contract if the price increase exceeds 5 %. Where the guest’s stay is subject to visitor’s tax, this levy is to be paid separately by the guest in accordance with the municipal regulations.
2.1 If included complimentary services, benefits or concessions (e.g. admission charges, travel fares or similar services) cannot be used owing to force majeure, breakdowns, seasonal closures or other circumstances for which the hotel is not responsible, no claims for replacement services or compensation in the form of money or benefits in kind may be asserted against the hotel.
- Unless other terms of payment have been expressly agreed, every invoice issued by the hotel is due for payment in full upon arrival, without deduction. Default of payment on even a single invoice entitles the hotel to discontinue further or future services for the customer.
3.1 The hotel is entitled to require an advance payment or security deposit from the customer when the contract is concluded. In justified cases, in particular where the customer is in arrears or the scope of the contract is extended, the hotel is also entitled to require an advance payment or security deposit after conclusion of the contract and up to the time the services are first used. In the event of late payment, the hotel is released from its obligation to perform and reserves all claims to performance against the booker, in particular those set out under clause 6 of this contract.
3.2 The hotel is furthermore entitled, while the services are being used, to issue an interim invoice at any time for services already rendered or for partial claims, and to demand immediate payment thereof.
- Unless individual agreements to the contrary have been made regarding payment for hotel services, a deposit of 50 % of the anticipated invoice total is payable for group bookings (15 persons or more) as security against any cancellation costs. Payment is due immediately upon confirmation of the reservation. In the event of late payment, the hotel is no longer obliged to perform. Other payment arrangements are valid only once confirmed by the hotel in writing.
- Reserved hotel rooms/apartments/holiday apartments are available to the customer from 15:00 on the day of arrival and until 10:00 on the day of departure. Where no time of arrival has been agreed, the hotel reserves the right to let reserved hotel rooms to other guests after 18:00. Reserved function rooms in the hotel are available to the customer only for the period agreed in writing. Use beyond the agreed period requires the hotel’s prior written consent. The customer acquires no entitlement to the provision of specific rooms, apartments, holiday apartments or function rooms. Should such reserved rooms be unavailable for reasons for which the hotel is not responsible, the hotel is entitled and obliged to arrange equivalent alternative accommodation – including, where reasonable, outside the hotel.
- The customer may amend or cancel reserved rooms, apartments, holiday apartments or function rooms, as well as packages, at least in text form. Unless an individual agreement to the contrary has been made (e.g. where the hotel accommodation contract was arranged by a third party), the hotel may assert its claim to performance either on a specific or on a flat-rate basis, giving credit for expenses saved.
6.1 Individual customers and groups
cancellation up to the 11th day before the agreed day of arrival: 0 % of the service price; cancellation from the 10th day before the agreed day of arrival: 50 % of the service price; where no cancellation is made or the guest does not arrive: 90 % of the service price
The customer reserves the right to demonstrate that no loss, or a substantially lower loss, has been incurred.
For your own protection we offer travel cancellation cover. The fee is 50,00 € per room / apartment. With this cover you may cancel free of charge up to 12:00 on the day of arrival.
6.2 Where the agreements with the hotel comprise more than 150 overnight stays per event, the periods stated above are each extended by 30 days. The date on which the declaration is received by the hotel is decisive for calculating these periods.
- Where the customer is entitled to withdraw from or cancel the contract free of charge under an individual agreement or under these General Terms and Conditions, the hotel is likewise entitled to withdraw from the contract within the agreed period if enquiries from other guests have been received for the booked rooms or function rooms and the customer, on being asked by the hotel, does not waive their right of withdrawal.
7.1 The hotel is furthermore entitled to withdraw from the contract for good cause.
Good cause exists in particular where:
a) force majeure or other circumstances for which the hotel is not responsible make performance of the contract impossible
b) rooms or function rooms are booked on the basis of misleading or false statements of material facts
c) the hotel has reasonable grounds to believe that use of the services may jeopardise the hotel’s business operations, safety or reputation
d) the customer’s financial circumstances deteriorate substantially after conclusion of the contract or insolvency proceedings are opened
e) amounts due to the hotel are not settled
f) the hotel’s name is used to advertise events without its consent
7.2 If performance of the contract is impossible, or possible only with considerable difficulty, owing to exceptional circumstances, force majeure or other events for which the hotel is not responsible (e.g. natural disasters, official orders, epidemics, pandemics, strikes or infrastructure failure), both contracting parties are entitled to withdraw from the contract. In such cases, services already rendered must be paid for; no further claims for damages shall arise.
7.3 The hotel must inform the customer without delay if it exercises its right of withdrawal. Payments already made will be refunded unless the hotel retains a claim to remuneration under clause 6.
- The provisions of state law on the protection of non-smokers apply within the hotel. The customer must observe these provisions and comply with the hotel’s corresponding instructions.
8.1 Where non-smoking areas are designated or the hotel is operated as a non-smoking hotel, smoking is permitted only in the areas provided for that purpose. In the event of breaches, the hotel is entitled to charge a reasonable flat-rate cleaning fee of 50,00 € to remove smoke odours and soiling. Further claims for damages are reserved, in particular where special cleaning is required, rooms cannot be let or fire alarm systems are triggered.
- The hotel exercises the right of control over its premises. The customer and their companions must follow the instructions of hotel staff. In the event of serious or repeated breaches of the house rules, disruption of business operations or endangerment of other guests or employees, the hotel is entitled to exclude the customer or individual participants from further use of the hotel’s services or to require them to leave the premises. In such cases the hotel’s claim to payment for the agreed services remains in force.
- For events with more than 12 persons (e.g. weddings, birthday parties, seminars, conferences, congresses, banquets, balls, exhibitions or lectures), any change in the number of participants must be notified in text form no later than three days before the event begins. Otherwise the agreed number of participants is binding for invoicing purposes.
- The organiser is liable to the hotel for payment of any additional services ordered by event participants. The customer must obtain any necessary official permits at their own expense and pay any public-law charges themselves (e.g. GEMA royalties).
- Decorative material or other items may not be put up without the hotel’s consent. The organiser is liable for any damage caused.
- The hotel’s liability for property brought onto its premises is governed by the statutory provisions of Sections 701 et seq. of the German Civil Code (BGB).
13.1 If a parking space is made available to the guest, this does not constitute a contract of safekeeping. Liability arises only in cases of intent or gross negligence on the part of the hotel.
- Faults affecting technical installations will be rectified immediately wherever possible.
- Bringing animals onto the premises and subletting the rooms provided require the hotel’s prior consent.
- The right to correct obvious errors as well as typographical or arithmetical mistakes in quotations or confirmations is reserved.
- The place of jurisdiction is Stendal/Germany, provided that the customer is a merchant or a legal entity under public law.
- Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
- Personal data is processed within the framework of the statutory data protection provisions (GDPR) for the purpose of performing the contract.
- The hotel is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
